It is not Said , it really happened

Egypt’s oldest English spoken newspaper The Egyptian Gazette published a report today about the Egyptian POWs, it is short an interview with lawyer Farial Abu El-Nagaa whose brother enigneer El-Aidei was killed in the 1967 Egyptian POWs massacres. Mrs. Farial is among the 250 families suing the Israeli government in front of the Egyptain courts after the broadcast of the infamous “Rosh Shaked“.

Now what stopped me in this report today was its introduction :

AN Egyptian lawyer, whose brother was one of some 250 unarmed prisoners of war (POWs) said to be killed in Sinai peninsula by the Israeli army after the 1967 war, has said that while the Egyptians want peace with the Jewish state, the Israeli military involved in the slayings must be punished !!

Said to be killed !!??

Are You kidding me ?? All this and the national Newspaper that is following the newspaper believes that it was said and that they were only 250 !!

The 250 were those who were killed by Shaked but there were thousands who were killed by the rest of the Israeli forces !!??

From another hand the court decided to adjroun the case again this time to January 12,2008 !!The reason is that the court wanted to give enough time to the lawyers to get documents from the Egyptian Ministry of Defense or this is what it said. Hopefully the Egyptian ministry of Defense will cooperate with the lawyers of the POWs families

We can sue Israel abroad without the approval of the Egyptian government

I made a quick interview with Ambassador Ibrahim Youssery on my Egyptian Chronicles blog and I did not forget to ask about the POWs case.

Ambassador Ibrahim Youssery took this stand this year to sue the Egyptian government in the court for exporting the Egyptian Natural gas to Israel despite the huge public refusal. Ambassador Youssery is a retired Ambassador since 1995 and currently work as international law lawyer. Already I should mentioned that he headed for three years as Head of the Egyptian Government committee for the revision of bilateral and multilateral treaties and the Deputy chief of the Egyptian delegation in the negotiation concerning the execution of the Taba award.

I asked him in the interview about several issues current causing buzz in Egypt whether from the exportation of the natural gas to Israel or the Salam 98 Ferry or the Um Rashrash case or the POWs Case. I asked him about the Egyptian POWs Case because I know from his long international legal expertise we can benefit.

Already my main question to him was about the possibility of suing Israel outside Egypt in international courts whether the ICC or the IJC

Here are the questions concerning the POWs

EC :The Egyptian POWs case is from the most important neglected cases in Egypt, as international law expert; can we go to the IJC or the ICC to sue Israel as citizens not as a state??

IY : We can peruse this matter by bringing it to international courts. There are some technical difficulties to engage the ICC, but the IJC has no jurisdiction here. I agree fully that the Egyptian POWs case is one of the most important neglected cases in Egypt. But we can always engage the Israeli criminals before any court (Pinochet , Mengistu, Sharon cases)

EC: Do we need the approval of the Egyptian state??

IY: We do not need the approval of the Egyptian state.

EC: Can the ICC investigate it without the approval of the Egyptian State??

IY: Yes the ICC can investigate it without the approval of the Egyptian State.

EC :If we go there, are the testimonies of the people of Sinai and the ex-POWs who witnessed the war crimes against our soldiers and officers plus the mass graves in Al Arish and across the rest of Sinai are enough to support our case and open an international investigation for War crimes, especially that there are some Israelis who confirmed our stories??

IY : Yes, the court can accept the testimonies of the people of Sinai and the ex-POWs who witnessed the war crimes against our soldiers and officers plus the mass graves in Al Arish and across the rest of Sinai.

EC: Why do you think the Egyptian government refuse to take it seriously despite it is a win case??

IY : The Egyptian government refuses to take it seriously despite it is a win case, because they don’t care a bit about people and they can not stand any American pressure.

As you can see we can sue Israel abroad in front of the ICC without the approval of the Egyptian State and we can win it with the testimonies of the witnesses and the evidence represented in the mass graves of our troops across Sinai

The foreign ministry is officially responsible of the POW Case in Egypt

On the 5th of March 2008, the Administrative court in Cairo issued a historical ruling oblighing the Egyptian foreign ministry to investigate the allegations that the Israeli Defense Forces “IDF” had killed Egyptian POWs in 1956 and 1967.

egyptianow-apThe court ordered the Egyptian foreign ministry to prepare a list with the names and numbers of the POWs killed by the IDF.The importance of that rule is that it is an official obligation on the Foreign

The ministry should open an immediate investigation in this important case.This court order comes as the end of a very long lawsuit filed against the Egyptian government by the families of the POWs and ex-POWs

The lawyer who filed the Suit is Wahid El-Oksori , the head of Egyptian Arab socialist Party and a veteran officer.

This is very important court order, it does not recognize the crimes but it orders the Foreign ministry to investigate the allegations,it opens the door officially

Still, I doubt that the Foreign ministry will obey the court’s order and it will not be the first time nor the first ministry or governmental authority that will ignore a court’s order. By the way about the list with names and numbers of the POWs, they can be easily done with the records of the reported missing officers and Soldiers from 1956 and 1967 from the Egyptian army archives.

Ok the 40th anniversary is coming just in 24 hours and I am ready for it ,there are already several updates in several sections

First of all the Law section is updated to include the Israeli Law

Second there is a page I think you must all read in the 1967 concerning the number of our POW,it is very very important please read till the end and tell me what do you

Third I made a section to answer back the Israeli counter allegations regarding the mistreatment of Israeli pows in Yom Kippur war.

Fourth I added the Al-Jazeera short special report about the 1967 six days war , where the guest a war veteran shares his memories including being an eye witness for terrible war crimes ,unfortunately it is in Arabic ,it is in the film section.

Fifth I added a page to the 1967 file regarding the forgotten Al-Ahram newspaper expedition back in year 1995.

Bad News and Good News

I have got Bad News and Good News as I think I will start with the Bad news before the Good news as I always do

The bad news I found out that Egypt can’t use the international criminal court not because it doesn’t prosecute in the crimes that took place before 2002 but because Egypt already is not a member , The Egyptian government signed it but didn’t ratify on it till now ,same thing for Israel who accused the ICC to be influenced by some countries !!

The good news is better , in fact it is a scoop in my humble opinion

The USS Liberty again whose crew came supporting Israel and left attacking the IDF and its governemtn till now

The files and the records of the USS Liberty may hold the solid evidence that proves our men in Al-Arish were killed in what is considered in the international laws as crime wars , already it is proved in the congress records that there were mass murders occured against the Egyptian POWs Yes it is ,and you can check it here in this website for the first time in an Egyptian Website

I am so thrilled with the findings I found regarding the USS Liberty and more thrilled to tell you that this year more files and records will be released this year from the NSA according to the law

Updates

Sorry for the lack of the updates in the past last couple of weeks I got busy with the referendum and the Arab Summit , the good thing that I got more and more coming in the way insh Allah

  1. The photos section in the 1967 is opened , from the photos you can see the huge numbers of the POWs and the humiliation they suffered from.
  2. The Laws section is updated with new information regarding the Camp David accords and the International crime court.
  3. The Al-Arish People testimonies section is also updated with several testimonies that go back to 1995

There is also a news update from Egypt regarding the official reaction , Mofid Shaab, the minister of legal affairs of the assembly said yesterday that Egypt requested the red cross to investigate the case officially, this statement came after accusations of the parliament members to the government and the foreign minister of being lazy

Comment: This is not the first time Egypt requests the red cross to investigate and it is not the first time the red cross investigates the case ,it did in 1995 and already according to eye witnesses the red cross knew about the war crimes that happened in the six days war since 1967 , in 1995 they found mass graves and they didn’t do anything to be really mentioned .

Already this is not a bad step but not an effective one , it is essential to make the world believes us as our creditability is not as before and thus an international proof is required ,but we shouldn’t act as if it were the only way
