Egypt’s Supreme Administrative Court: The Egyptian government should demand 1956 and 1967 POWs rights

On Saturday, Egypt’s Supreme Administrative court made headlines once again when it rejected the Egyptian government’s appeal against previous administrative court order obliging it to demand the rights of the 1956 and 1967 Egyptian POWs officially.

The Supreme Administrative court headed by honourable Judge Ahmed El-Shazly upheld the March 2008 Administrative court’s ruling obliging the Egyptian government to demand the rights of the Egyptian POWs in the 1956 and 1967 wars.

In 2001, a group of  Egyptian POWs families and ex-POWs represented by lawyer and 1973 war veteran Wahid El-Oksori filed a lawsuit in front of the Egyptian administrative court demanding the Egyptian government to investigate the allegations against the Israeli Defense Forces “IDF”.

In March 2008, the administrative court issued its court ruling obliging the Egyptian foreign ministry to investigate the allegations.  Following that court order, the Egyptian government represented in the State Lawsuits authorities

The Egyptian government represented in the State Lawsuits authorities appealed the court ruling in front of the Supreme Administrative court.

Only on 21 January 2018, the Supreme Administrative court made its final verdict rejecting the Egyptian government’s appeal and upholding the 2008 court ruling.

The State lawsuits authority claimed in its appeal that the Egyptian government did not fail its duty. It said that ousted President Mubarak demanded Israel to investigate the allegations of killing the Egyptian POWs in 1995 and that the Israeli government formed a fact-finding committee to investigate the matter. That alleged fact-finding committee finished its work in 1998 but did not share its results with the Egyptian government according to the government’s representative in court.

The State lawsuits authority added that the Egyptian foreign ministry followed the Shaked documentary in 2007 and raised the matter with Israel as well as the Red Cross.  The government’s lawyer added in its appeal that Camp David accords and suspected that the families of the POWs are related to the POWs in the first place !!

According to the Supreme Administrative court’s reasoning that the documents presented to it that the IDF committed war crimes against Egypt and the Arab military and that the Egyptian government failed in prosecuting Israel criminally as well in demanding compensation international for the victims. 

Head of Supreme Administrative court Judge Ahmed EL-Shazly made headlines last week when the Supreme Administrative Court rejected the appeal of the Egyptian government against the Administrative court ruling in April 2016 annulling the Egyptian Saudi deal to redraw the maritime deal, which placed the Red Sea islands Tiran and Sanafir under Saudi Sovereignty.

Ironically, the State lawsuits authority brought up once again the jurisdiction of the Supreme Administrative Court in its lawsuit just like Tiran and Sanafir.

There has been no reaction from the Egyptian foreign ministry about this court ruling yet.

The foreign ministry is officially responsible of the POW Case in Egypt

On the 5th of March 2008, the Administrative court in Cairo issued a historical ruling oblighing the Egyptian foreign ministry to investigate the allegations that the Israeli Defense Forces “IDF” had killed Egyptian POWs in 1956 and 1967.

The ministry should open an immediate investigation in this important case.This court order comes as the end of a very long lawsuit filed against the Egyptian government by the families of the POWs and ex-POWs

The lawyer who filed the Suit is Wahid El-Oksori , the head of Egyptian Arab socialist Party and a veteran officer.

This is very important court order, it does not recognize the crimes but it orders the Foreign ministry to investigate the allegations,it opens the door officially

Still, I doubt that the Foreign ministry will obey the court’s order and it will not be the first time nor the first ministry or governmental authority that will ignore a court’s order. By the way about the list with names and numbers of the POWs, they can be easily done with the records of the reported missing officers and Soldiers from 1956 and 1967 from the Egyptian army archives. 

Important Updates: The complete script of Shaked in English

At last I did it and I translated the Rush Shaked Documentary scriptmenu_17 from Arabic to English so all the people will understand what was said in the controversial Israeli documentary. I translated from the origin Arabic script I found in my Cruel World blog.It is very important because according to it that is the Second Israeli confession of committing crimes against the Egyptian POWs in 1967 after the veterans confessions of committing war crimes in 1956 against our POWs from Militaries and civilians. I am sorry if there were mistakes in the Hebrew names but you must know that all that delay was to check from the names and to write it correctly ,I tried as possible to check from the names several times and some of them from those who appeared in the documentary turned to be from the important officers in the IDF as you will know The documentary and what was said in it are the solid proof against the claims of the director of the same director of the documentary who lied and said that the Egyptians were not mentioned in the documentary !! Well ha can say anything especially when the documentary was never shown again , also it is a solid proof against the claims of the Shaked battalion veterans who denied that they had killed any Egyptian pows during 1967 You can find the script in English here please spread the news Again if you find any mistakes in the Hebrew names please tell me and I will correct them

Important lecture and book discussion alert

Next Thursday the 20th of September in Cairo ,there will be very important lecture and a book discussion related to the case of the Egyptian POWs

The book is “The People and the war” which was written by 1967 and 1973n5960210754_474 veteran Colonel Osama El-Sadek whose testimony about what had happened from crimes against the Egyptian army by the IDF is considered one of the most important testimonies from what it contained from details and incidents

Thanks to our dear friend O2A I was able at last to find Al-Jazeera’s very important documentary “The Way to Atlit” , before there was “Rush Shaked” there was “The Way to Atlit” , the “Way to Atlit” was a special episode from the Al-Jazeera’s famous TV Show “Top secret” which is presented by “Youssry Fouad”

This special episode is very important as it includes Israeli testimonies from historians and veteran officers too from inside Israel , this is beside the Egyptian testimonies from veterans of 1956 and 1967 wars

It is very rare episode and it was hard to find , in fact it is miracle to find it now

A remembrance day again and again for the POWs

I won’t stop and I won’t give up simply because our great men were and are not less than anyone else

The Armenians celebrate the Armenian Genocide remembrance day on the 24th of April ever year

The British celebrate their remembrance day on the 11th of November every year

The Jews celebrate the Yom HaShoah on the 19th of April every year

And We Must celebrate our POWs who were killed in 1956 and in 1967 on the 5th of June Every year

The red cross denial is no proof

I don’t believe the red cross and I don’t care what they say because I have got my people’s testimonies and they can’t be liars , my people for the great people of Sinai ,from Al-Arish who buried the POWs by their hands  and know the place of mass graves till our day

My people from the POWs who survived ,whether those who managed to escape or those who survived the hell of Atlit

If they don’t believe my people I don’t care

They got the Israeli confessions of General Biro in 1956 stating clearly as sun what he did from war crimes  against not military but also Egyptian civilians

They can prove if they want , but they don’t same like the Egyptian regime

Today Egyptian Foreign minister talked in TV on air about this report and he was so nervous and angry in a strange way I don’t why , he kept speaking for himself the revenge of those POWs was taken in 1973 war , well he was speaking for himself not for the majority of the Egyptian people

he received the report of the red cross and sent it to the assembly to be discussed and soon officially the scenario of what happened in 1995 from closing the discussion about the POWs will happen

Big fight in the assembly because of the POWs

Unfortunately I missed watching this session of the Egyptian assembly on air yesterday , now I guess it was edited to remove all what happened in it .Yesterday Foreign minister “Ahmed El-Gait” attended the meeting with the assembly members to discuss the updates of the POWs case and to discuss his statement about it , yet it didn’t go easy at all , it turned in to some kind of war of the world between the foreign minister and the MPs to become a historical session as the for the first time a foreign minister in Egypt would face such attack in the assembly.

The MPs accused the minister of ignoring the case where as the minister defended his position explaining the difficulty of the case as we can’t go to the international criminal court because it doesn’t look in cases that took place before the year 2002 , fact that is mentioned in the law section

Since then the arguments began ,the minister also hinted to fact I didn’t know before that if we want a special criminal court like the court of the war crimes that happened in Yugoslavia needs a special order for the security council and of course this would be like a mission impossible as the minister hinted.

It will be met with a veto from some of the permanent member countries in the council , if not most of them or all of them ,I don’t need to speak more.

 This did n’t like many MPs especially the minister was nervous that MP Mohamed Abd El-Fatah Omar from the National Security committee asked how , the minister answered angrily that because we have relations with other countries and we don’t need to burn it and that he couldn’t speak in front of the television and media, then the minister paused for a while and asking again even more angrier whether if the MP needed to know why the Russian federation would refuse and that he wouldn’t say because of the television , the head of the assembly Fatahi Sorror said that he could order to make it a close session but the suggestion was refused “well thank God it wasn’t accepted because then we couldn’t know exactly what happened in that stormy session”

The arguments continued and turned in to a confront between the minister and MP Rageb Hamida reached to the level that Minister “Abu El-Gait” described the talk of the MP as “Nonsense” which made the later answered or rather fired back saying that the Minister was a “Nonsense man” with a support from the other MPs that made both the head of the assembly and the minister of the parliament affairs try to calm things down.

And they succeeded in that thank Goodness. The foreign minister than apologized for his behavior and confirmed that he and the Egyptian foreign ministry refused to get one penny from Israeli as compensation for the POWs of 1967 and 1956 As if Israel is ready to pay !! because

Egypt is one who pays for its sons who scarified their lives for her !!

Already he didn’t shut here ,but continued saying what made the headlines in newspapers like Daily El-Dostor as a parody

I was going to kill myself from sadness on what happened for the Egyptian POWs on the 10th of June 1967

Just for the record the Egyptians didn’t know what happened to their sons on the 10th of June 1967 because the war was just started on the 5th and President Nasser presented his resignation on the 9th and after that there was the mini war between Nasser and Amar ,So I don’t know how he knew about what happened to our men in Sinai in that short time !!

From their side; the MPs accused the ministry to be weak that it gave up the Egyptian rights for the sake of Israel to the extent that our diplomats are being attacked abroad and that Saudi Arabia took the leadership from us and they requested that the statements of the Foreign ministry to hold some more dignity and strength than what they are now.

The head of the Parliament “Fatahi Sorror” said that he requested from the Euro Mediterranean parliament to investigate the case and requested also from the Egyptian parliament to form a  permanent committee ,its membership will include the MPs and officials from the Foreign ministry to document all the evidences that prove the Israeli guilt.

As you can see it was one hell of a session , you know I am surprised that MP “Mustafa Bakery” wasn’t among the angry MPs !!

Seriously if you want my opinion technically what the Minister said about the international court and the security council is unfortunately true ,already you can check the Laws section to know more and of course we don’t need to speak about the Israeli influence in the security Council , it is enough now that last year the security council did anything against the Israeli crimes in Lebanon because of the American support , it is something well known

But I disagree with him regarding the compensation , those men and their families are not less than the Holocaust victims and survivals with my all respect to them

Also I agree that the minister and the ministry are not doing their job as expected from them not only regarding this sensitive issue but other issues that made Egypt actually to lose its position in the Arab world to the Saudi Arabia.

Another thing I don’t respect the circus that happened yesterday starting by the minister and the MPs ,seriously the assembly has traditions to be respected

New testimony

I added today a new Egyptian Military testimony not from a POW but more from a survivor

It is the longest testimony and it is one of the best example of how it was in Sinai in June 1967 and it is the 16th in that section

I am sorry if there is any spelling or grammar mistake in the translation , I still got more testimonies 1995 to be added ,not to mention the photos and videos ,please pardon if I appeared lazy ,I am not.

Of course you noticed that suddenly things are getting quiet , well the best thing that there are others who promised not to forget at least I am one of them.

Officials are speaking in a strange way like they never knew that mass murders happened in six days war ,I mean every vateran in 1967 can tell you two or three stories that confirms the existance of the mass murders

And it is not only the mass murders of 1967 , it is also the mass murder of 1956
